ESCOLAR Project Website Terms and Conditions of Use
These Terms and Conditions of Use (“Terms of Use”) apply to the University of Oregon’s (“UO”) ESCOLAR Project Website located at escolar.tech and all associated sites linked to that site by the University of Oregon (collectively, the “Site”) provided by the UO on behalf of its Center for Equity Promotion for the ESCOLAR Project. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE.

Terms of Use Updates. The UO reserves the right to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

Ownership of Content. The UO owns, controls or has a license to all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork computer code, and educational materials (collectively, “Site Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Site Content, contained on the Site, and the UO’s interest in the Site Content is protected by applicable law.

License. Subject to your compliance with these Terms of Use, the UO grants you a limited, non-exclusive, non-transferable, non-sublicensable license to enter and use the Site. Except as expressly provided in the following sentence, this license does not include any resale or commercial use of the Site and Site Content; any derivative use of the Site and Site Content; any downloading or copying of account information for the benefit of a merchant; or any use of data mining, robots, or similar data gathering and extraction tools. The educational materials found on the Project ESCOLAR Website (the “Project ESCOLAR Content”) is available for your use under a Creative Commons Attribution 4.0 International (CC BY 4.0) available for your review at https://creativecommons.org/licenses/by/4.0/.

Use of Non-Project ESCOLAR Content Site Content, Services, & Marks. UO or its licensors, suppliers, publishers, rights holders, or other content providers reserve and retain all rights not expressly granted to you in these Terms of Use. Except as these Terms of Use expressly provide, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, any part of the Site and its Content, except for Project ESCOLAR Content as provided above, without the UO’s express prior written consent. You may not frame or utilize framing techniques to enclose any UO trademark, logo, or other proprietary information (including images, text, page layout, or form) without the UO’s express written consent. You may not use any meta tags or any other "hidden text" utilizing UO's name or trademarks without the express written consent of the UO. You may not misuse UO's Site or Site Content.

Prohibited Uses. You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Site
Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Site Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

Unauthorized Access. You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any UO server, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.

Changes to Services and Content. The UO may make changes to any Site Content at any time, without notice. The Site Content may be out of date, and the UO makes no commitment to update the Site Content.

Compliance with Terms of Use, Applicable Law and Termination. You may use this Site and Site Content only as permitted by law. The licenses granted by the UO terminate if you do not comply with these Terms of Use or the license for the Project ESCOLAR Content.

Use of Personally Identifiable Information. Information submitted to the Site is governed according to the ESCOLAR Project’s Privacy Policy. Although sections of the Site may be viewed simply by visiting the Site, in order to access some Site Content, and/or additional features offered at the website, you will need to sign on with a unique, anonymous log-in code number provided to you by the ESCOLAR Project. You are responsible for maintaining the confidentiality of the log-in number and are fully responsible for all activities that occur in connection with your account. You agree to immediately notify us of any unauthorized use of your log-in number or any other breach of security. You further agree that you will not permit others, including those whose accounts have been terminated, to access the website using your log-in number. You grant the ESCOLAR Project the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the website. The project cannot and does not assume any responsibility or liability for any information you submit, or your or third parties’ use or misuse of information transmitted or received using website. Reservation of Rights. Limitation of Liability. In no event will the UO be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if the UO has been advised of the possibility of such damages.

Indemnification. To the fullest extent permitted by the laws of the jurisdiction in which your headquarters is located, you agree to protect, indemnify, and save UO, its officers, directors, employees, and students, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against the UO by any third party due to or arising out of or in connection with your use of the Site or Site Content.

Governing Law & Jurisdiction. You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Oregon without regard to its conflicts of laws provisions. You agree that exclusive jurisdiction for any claim or dispute with us or relating in any way to your use of this site or app resides in the courts of Lane County, State of Oregon, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Lane County, State of Oregon, in connection with any such dispute and including any claim involving us or our affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

Severability. If a court of competent jurisdiction determines any term or provision of these Terms of Use is invalid or unenforceable to any extent, it will not affect the remainder of the Terms of Use, and each term and provision of these Terms of Use will remain valid and enforceable to the fullest extent law allows.

Integration. These Terms of Use constitute the whole legal agreement between you and the UO in regards to your use of the Site.
